Ngage.ai Privacy Policy
1. Purpose and Scope
This Privacy Policy (“Policy”) explains how personal information is collected, used, and disclosed with respect to your use of our website located at www.Ngage.ai (the “Site”) and the software and services accessed through the Site and your mobile device (the “Service”), provided by Mendios Technologies, or its subsidiaries or affiliated companies (“Ngage.ai”, “we” or “us”), so you can make an informed decision about using the Service. This Policy applies to all of the products, services and websites offered by Ngage.ai. Product specific privacy notices may be posted to explain our products in more detail.
By using the Service, you represent that you are 13 years old or older and consent to the privacy practices described in this Policy, as may be modified by us from time to time. We reserve the right to change the provisions of this Policy at any time. We will alert you that changes have been made by indicating on the top of the privacy policy the date it was last updated. Your use of the Site following the posting of such changes or revised statement shall constitute your consent to any changes in our privacy practices, and you expressly waive any right to notice of such changes. We encourage you to review this Policy whenever you visit our Site to make sure that you understand how any personal information you provide will be used.
2. Transparency Notice - Information we collect and how we use it
Ngage.ai collects Personal Information regarding its current, prospective, and former clients, customers, users, visitors, guests, and employees (collectively “Individuals”).
We may collect the following types of information:
Ngage.ai Customers - If you are a Ngage.ai Customer, you may provide Personal Information when you register with us through the Site to create and manage apps, such as your name, company name, email address, and “Payment Information” such as billing address and credit card information.
End Users - When you download or use the Ngage.ai App, any app published there or elsewhere, and/or use app through the Site, you may choose to provide Personal Information for your registration and/or profile as follows: Name, email, photo/profile image, Company, Position/Title, Gender, phone number, and/or website (“Profile Information”). Linked social media accounts such as Facebook, Twitter, Google+ and LinkedIn (“Social Information”). If, when you create an account with us, you may choose to login using certain social media accounts (Facebook, LinkedIn, etc). In this case, we collect the login identifier and password from this account (“Social Logins”). We collect your Mobile ID when you download the Ngage.ai App or a branded Ngage.ai app. If your device enables location services for the Ngage.ai App, we will collect information about your location when you use the App. You may send messages to other End Users or connect with them, in which case we will collect records and data reflecting your interactions with the other users. You may be asked, but not required, to complete surveys about your use of the Ngage.ai App. Note that this information is treated like Profile Information for purposes of this policy.
Visitors - This Section describes the information that we may collect from Visitors. To the extent you are a Ngage.ai Customer or an End User and visit the Site or use the Ngage.ai App, this Section will apply to you as well: If you contact us by email or by filling-out a registration form, we may keep a record of information you provide, such as contact information and correspondence. We will collect Usage Information reflecting your behavior on the Site. We may use session and persistent cookies, both first-party and third-party, to collect information about your visits to the Site.
Additional Information and Data Collection
- Cookies – When you visit the Site, we send one or more cookies to your computer or other device. We use cookies to improve the quality of our service, including for storing user preferences, improving templates and analytic, and tracking user trends. Ngage.ai also uses cookies to help advertisers and publishers serve and manage advertisements across the Site.
- We, our advertisers and ad serving companies may also use small pieces of code called “web beacons” or “clear gifs” to determine which advertisements and promotions users have seen and how users responded to them.
- Log information – When you access the Site via a browser our servers automatically record certain information. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser or your account.
- User communications – When you send email or other communications to Ngage.ai, we may retain those communications in order to process your inquiries, respond to your requests and improve our services. When you send and receive SMS messages to or from one of our services that provides SMS functionality, or submit communications regarding mobile application services, we may collect and maintain information associated with those messages, such as the phone number, the wireless carrier associated with the phone number, the content of the message, and the date and time of the transaction. We may use your email address to communicate with you about our Services.
- Content – Content you post, publish, or display on Ngage.ai to create your web site. Affiliated services on Ngage.ai – Other sites offer some of services on or throughout the Site. Personal information that you provide to those sites may be sent to Ngage.ai in order to deliver the Services. We process such information under this Privacy Policy.
- Ngage.ai Extension Gallery – Ngage.ai may make available third party applications, such as mash-ups, gadgets, APIs or extensions, through its Services. The information collected by Ngage.ai when you enable a third party application is processed under this Privacy Policy. Information collected by the third party application provider is governed by their privacy policies. The information specific to that application will be shared with the Company. This includes location-enabled overlays. If you use those overlays, the third party provider may receive information about your actual location (such as GPS signals sent by a mobile device) or information that can be used to approximate a location (such as a cell ID). This information will not be stored by Ngage.ai.
- Other sites – This Privacy Policy applies to Ngage.ai’s Services only. We do not exercise control over the sites displayed as advertisements or other links from within our various Services. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you.
Mobile-specific information we collect Most of the personally identifying information we collect is what you tell us about yourself.
- We record your phone number when you send it to us.
- If sent to us, we will associate your phone number with your Ngage.ai Account.
Most of the other information we collect for mobile, such as your device and hardware IDs and device type, the request type, your carrier, your carrier user ID, the content of your request, and basic usage stats about your device and use of Ngage.ai mobile application services does not by itself identify you to Ngage.ai, though it may be unique or consist of or contain information that you consider personal
3. How Ngage.ai uses your information
We acquire, hold, use, and Process Personal Information about Individuals for a variety of business purposes, including:
Ngage.ai Customers
- We use your Personal Information to provide and improve the Services, process payments, complete your transactions, administer your inquiries, and contact you regarding account activities, new version and product offerings, or other communications relevant to the Services.
- If you interact with End Users through a mobile app, for example by sending notifications or other information to them, we keep records of such messaging on our servers and use it in the operation of the Services.
- Your mobile app may be accessible via search engines or similar services.
- You can keep your mobile app private by adjusting your privacy settings. You Content will be visible to any End Users who download the applicable mobile event app, and Ngage.ai does not control the use or dissemination of Content in such cases by End Users, Visitors, or any third party. You are solely responsible for obtaining the consent of any data subjects whose Personal Information might be reflected in a mobile app you create using the Services.
End Users
- We use Profile Information and Social information to populate a profile that is visible to other users of the Services. If you do not want other End Users to see this information, you should not input it into the Services. Ngage.ai cannot and does not control the actions taken by other End Users with information they can access through the Services.
- We also share Usage Information and Personal Information about your use of a particular mobile app with the Ngage.ai Customer who created the Ngage.ai app. This may occur through the Ngage.ai branded App or a white-label branded app, but in a branded app the Ngage.ai Customer may request additional Personal Information from you. You should consult that Ngage.ai Customer, its privacy policy, and or its support team for details about how they use such information. Ngage.ai Customers may use information, including Personal Information, to provide online advertising on a mobile app and to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you. Ngage.ai is not responsible for the privacy practices or policies of Ngage.ai Customers or the content of such advertisements. Ngage.ai does not restrict or control the use of Personal information about End Users by Ngage.ai Customers, who may share your information with, for example, event sponsors.
- If you allow another End User to scan your QR Code, you will receive an “in-app connection” from that End User and your first and last name will be visible to them. If you accept the End User’s in-app connection request, they will be able to view the Personal Information you have made available in your Ngage.ai profile such as your email address, phone number, company, website, and social media profiles.
- If you register for an event and/or have your QR code scanned or otherwise check-in using your Personal Information, Ngage.ai will share your Personal Information with the Ngage.ai Customer associated with the event.
- We use your location, if available, to tailor the Services to you and offer you more relevant information about your Ngage.ai app, event, location, or other nearby users.
- We use information about your interactions with other End Users or mobile app administrators to operate and improve the services, deliver communications between you, and/or notify you that you have relevant information available to you to review within the customer branded white-labeled app or Ngage.ai App.
- We use your Personal Information to communicate relevant information to you about the Services, your mobile app, or the Ngage.ai App via email, to authenticate your access to the account (including by using Social Logins to authenticate your login to our own Ngage.ai App). It is possible that, because of the nature of the Ngage.ai app you download using the Ngage.ai App or otherwise, certain potentially-sensitive information about you may be logged on our systems.
- End Users can send a request to support@Ngage.ai.com to request that their Personal Information be deleted from our systems and not further shared with Ngage.ai Customers or other third parties. Note that this may require that you delete your Ngage.ai account and/or cease using one or more Ngage.ai mobile apps.
Visitors
- We may use information you input into a registration form or support contact to respond to your inquiries. In addition, we may use such details to send you information regarding the Site and/or the Services.
- We use Usage Information so that we can improve the Site, optimize its performance, and learn which parts are most popular to Visitors.
In addition to the above, we may use the information we collect to:
Provide, maintain, protect, and improve our Services (including advertising services) and develop new services based on user activity and preferences; and Protect the rights or property of Ngage.ai or our users. Store, process and maintain your content in order to provide the Service to you. Content you create with Ngage.ai may, if you choose, be read, copied, used and redistributed by people you know or, again if you choose, by people you do not know. We suggest avoiding sharing sensitive information. However, if you choose to do so, use care when sharing.
If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.
Ngage.ai processes personal information on Amazon Web Services. Ngage.ai uses Amazon Web Services to host its infrastructure. Amazon Web Services servers are located in the United States of America, Europe and Asia. In some cases, we process personal information outside your own country.
Choices
You may terminate your use of Ngage.ai at any time.
Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Ngage.ai features and Services may not function properly if your cookies are disabled.
4. Information sharing - Ngage.ai may disclose information
Ngage.ai only shares personal information with other companies or individuals outside of Ngage.ai in the following limited circumstances:
We have your consent. We require opt-in consent for the sharing of any sensitive personal information. We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures. We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Ngage.ai, its users or the public as required or permitted by law.
If Ngage.ai becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, we will ensure the confidentiality of any personal information involved in such transactions and provide notice before personal information is transferred and becomes subject to a different privacy policy.
5. Information security
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and strategic structuring of our infrastructure.
We restrict access to personal information to Ngage.ai employees, contractors and agents who need to know that information in order to process it on our behalf. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
Accessing and updating personal information
When you use Ngage.ai Services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.
Privacy Shield – International data transfers
If you choose to use the Services from the European Union (“EU”), Switzerland or other regions of the world with laws governing data collection and use that may differ from the law of the United States of America (“US”), please note that you are transferring your personal information outside of those regions to the US for storage and processing. By providing any information, including personal information about you, on or to the Services, you consent to such transfer, storage, and processing. We participate in, and comply with, the Privacy Shield Principles regarding the collection, use, sharing, and retention of personal information from the EU and Switzerland. If there is any conflict between the terms in this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Our participation in Privacy Shield applies to all personal data that is subject to this Policy and is received from the EU or Switzerland. As part of our participation in Privacy Shield, if you have a dispute with us about our adherence to the Privacy Shield Principles, we will seek to resolve it through JAMS, an independent alternative dispute resolution body based in the US. To make a claim with JAMS under the Privacy Shield Principles, please visit https://www.jamsadr.com/eu-us-privacy-shield. In certain circumstances, you may have the right to invoke binding arbitration under Privacy Shield, as described in Annex I to the Privacy Shield Principles, which can be found at the following URL: https://www.privacyshield.gov/article?id=ANNEX-I-introduction. As a Privacy Shield participant, we are subject to the investigatory and enforcement powers of the US Federal Trade Commission and other authorized statutory bodies. Under certain circumstances, we may be liable for the transfer of personal data that we receive and subsequently transfer to a third party, as described in the Privacy Shield Principles. As described in this Policy, we may share information with third parties and may be required to disclose information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. Finally, you may contact us at support@Ngage.ai.com, or write to us at the address listed at the end of this Policy, to request access to your personal information to be able to correct, amend, or delete that information where it is inaccurate or has been processed in violation of the Privacy Shield Principles, or to request that your personal information not be used for a purpose that is materially different from the purposes for which it was originally collected or for purposes subsequently authorized by you. You may also contact us to request that we do not disclose your personal information to third parties (other than those that are acting as our agent to perform tasks on our behalf, such as payment and data processors). However, as the core functionality of the Services require that we share your information with Clients, you will not be able to use the Services if you request that we not disclose your information to third parties.
Enforcement
Ngage.ai regularly reviews its compliance with this Privacy Policy. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between Ngage.ai and an individual.
Changes to this Privacy Policy
Please note that this Privacy Policy may change from time to time. We will post any Privacy Policy changes on this page and updated the “Last Modified” date.
Your Consent
By using our Site you consent to our collection and use of your personal information as described in this Privacy Policy.
